1. Purpose and scope

These General Terms and Conditions of Sale (the "Terms") govern the sale of products concluded on the Website between JAPANRESELL (the "Seller") and any natural person acting for non-professional purposes (the "Customer").

Sales to businesses (resellers) are subject to specific terms, available in the Retailer Area or on request.

2. Acceptance and changes to the Terms

The Customer accepts the Terms by confirming their order. The applicable Terms are those in force on the date of the order. The Seller may change them at any time; the new Terms only apply to orders placed after they are published.

3. Products

The Seller offers products imported from Japan: trading cards, magazines, manga, artbooks, figures and other collectibles. Unless otherwise stated, products are official, original Japanese editions and new.

• Description: the essential characteristics of each product are shown on its product page. Photos are as accurate as possible, but slight differences (colours, reflections) may exist.
• Second-hand products: their condition is specified on the product page. Additional photos can be requested before purchase.
• Graded cards: the grade is awarded by an independent grading company (PSA, BGS, CGC…), whose certification number is shown on the product page. The Seller guarantees that the card delivered matches this certificate.
• Japanese magazines: they are often printed on recycled paper and may be delivered by the publisher in shrink wrap or tied with string. Slight original printing or handling marks are therefore possible and do not constitute a defect.
• Manuscript pages and large-format products: for optimal protection, separate shipping is recommended.

The trademarks, names and characters featured on the products belong to their respective owners. JAPANRESELL is an independent retailer and is not affiliated with these owners.

Offers are valid while stocks last. The Seller may limit the quantities ordered per Customer for certain products.

4. Prices

Prices are shown in euros, including all taxes (VAT included), excluding shipping costs. Shipping costs are shown before the order is confirmed.

Some second-hand products are sold under the VAT margin scheme: VAT is therefore not shown separately on the invoice.

For deliveries outside the European Union, customs duties and local taxes may be charged by the destination country. These are payable by the Customer.

The applicable price is the one displayed when the order is confirmed.

5. Orders

To order, the Customer selects their products, enters their details, chooses their shipping and payment methods, checks the order summary (and may correct any errors), then confirms and pays. The order is confirmed by email.

The Seller may refuse or cancel an order in the event of a previous dispute with the Customer, an abnormal order or suspected fraud. The Customer is then refunded in full.

Orders and invoices are archived on a reliable and durable medium and can be provided to the Customer on request.

6. Pre-orders

Some products are offered for pre-order before their release in Japan. Payment is due when the order is placed.

• The release date shown is the one announced by the publisher or manufacturer. It is an estimate and may be changed by them.
• If the release is postponed, the Customer is informed by email and may cancel their pre-order at any time before shipping, with a full refund.
• If the product is ultimately cancelled by the publisher or the Seller is unable to obtain it, the Customer is refunded in full.
• Pre-orders are shipped as soon as the products are received, in order of purchase.
• When an order contains both in-stock and pre-order products, everything is shipped once the pre-orders arrive, unless the Customer requests separate shipping (additional shipping costs may then be charged).

7. Payment

Payment is made online, securely, by bank card, PayPal, Apple Pay or Google Pay. Payment in 3 or 4 instalments is available with Alma, subject to Alma's approval.

The Seller never has access to the Customer's full bank details. If payment is declined, the order is cancelled.

Products remain the property of the Seller until the price has been paid in full.

8. Delivery

Products are delivered to the address or pickup point specified by the Customer, via La Poste (Colissimo, tracked letter), Mondial Relay, InPost, DPD or FedEx, depending on the method chosen when ordering.

• Lead times: orders for in-stock products are prepared within approximately 2 to 3 business days. The carrier's delivery time is then added and is shown when ordering. If no lead time is stated, delivery takes place no later than 30 days after the order.
• Delay: if the lead time is exceeded, the Customer may ask the Seller to deliver within a reasonable additional period. If delivery does not take place within this new period, the Customer may cancel the order and be refunded in accordance with Articles L.216-6 et seq. of the French Consumer Code.
• Receipt: the Customer is asked to check the condition of the parcel on receipt and to report any anomaly (damaged or opened parcel) to the carrier and the Seller as soon as possible, with photos.
• Tracked letter: this shipping method does not allow for reinforced protection. For fragile or valuable products, shipping as a parcel is recommended.
• Uncollected parcel: if a parcel is not collected within the pickup point's holding period and is returned to the Seller, reshipping costs are payable by the Customer. If the Customer prefers a refund, the original shipping costs are not refunded.
• Incorrect address: the Seller is not liable for failed delivery due to an incomplete or incorrect address provided by the Customer.

The Seller remains responsible for the products until they are handed over to the Customer. In the event of loss or damage during transport, the Seller will replace or refund the product.

9. Right of withdrawal

In accordance with Article L.221-18 of the French Consumer Code, the Customer has 14 days from receipt of their order to withdraw, without having to give a reason.

• How? The Customer informs the Seller of their decision by means of a clear statement, via the form on the Website's "Withdrawal" page, by email at contact@japanresell.fr, or using the model form in the appendix.
• Return: the Customer sends the products back no later than 14 days after communicating their decision, to: JAPANRESELL, 18 Rue Yves Montand, 34090 Montpellier, France. Return costs are payable by the Customer.
• Refund: the Seller refunds the price of the products and the original shipping costs (based on the cheapest standard shipping method offered) within 14 days of the withdrawal. The Seller may withhold the refund until the products, or proof of their return shipment, have been received. The refund is made using the same payment method as the order.
• Condition of products: products must be returned complete and in their original condition. The Customer is liable for any loss in value resulting from handling beyond what is necessary to establish the nature and characteristics of the products (for example: an opened sealed product, an opened booster, a card removed from its grading case). The refund may then be reduced accordingly.

10. Legal guarantees

All products are covered by the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

• The Customer has 2 years from delivery to make a claim under the guarantee of conformity.
• A lack of conformity is presumed to have existed at the time of delivery if it appears within 24 months of delivery, or within 12 months for a second-hand product.
• The Customer may obtain the repair or replacement of the product or, failing that, a price reduction or the cancellation of the sale.
• Under the guarantee against hidden defects, the Customer has 2 years from the discovery of the defect and may choose between cancelling the sale and a price reduction.

For any request, the Customer contacts the Seller at contact@japanresell.fr, with their order number and, if possible, photos of the product.

11. Complaints

For any complaint, the Customer may contact customer service at contact@japanresell.fr or via the Website's Contact page. The Seller undertakes to seek an amicable solution as quickly as possible.

12. Liability

The Seller is not liable for non-performance of the contract attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to force majeure. The Customer is informed as soon as possible.

13. Intellectual property

The content of the Website (texts, photos, logos, layout) is the property of JAPANRESELL or of its authors. Any reproduction without authorisation is prohibited.

14. Personal data

The Customer's data is processed in accordance with our Privacy Policy, available on the Website.

15. Governing law and disputes

These Terms are drawn up in French and governed by French law. In the event of a dispute, and failing an amicable solution, the Customer may refer the matter to the court of the place where they resided at the time of the order or of the event giving rise to the damage.
